Terms & Conditions of Service

These Terms and Conditions ("Terms") govern the services provided by Lucid Pulse ("we", "us", or "our") to our clients ("you", "your"). By engaging with our services, you agree to the following terms.


1. Website Creation & Development

  • We provide custom website design and development services based on the scope agreed upon in your proposal or contract.

  • Any changes to the original scope may result in additional charges and timeline adjustments.

  • Final approval of the website marks the completion of the project, after which any further updates will fall under a maintenance package or hourly rate.

  • Please note: If the completed website is migrated to third-party hosting, we cannot guarantee full functionality or provide post-launch support for issues arising from compatibility or configuration differences.

  • Our hosting environment is fully optimised, meets modern web standards, and is maintained with a high level of performance and security.


2. Website Maintenance

  • Maintenance packages include plugin/theme updates, minor content edits, regular backups, and security monitoring.

  • Unless otherwise agreed, maintenance is billed monthly or annually.

  • We are not responsible for downtime, issues, or breaches caused by external hosting providers or client-side changes made outside our service scope.


3. Client Portal Access (Lucid Pulse Portal)

  • Clients are granted secure access to the Lucid Pulse Portal to manage invoices, view contracts, proposals, quotes, and submit support tickets.

  • Portal credentials must not be shared with third parties.

  • We reserve the right to revoke access in cases of misuse or if security concerns arise.


4. Support Tickets

  • All support requests must be submitted via the Lucid Pulse Portal to ensure proper tracking and response.

  • Response times vary depending on the service agreement in place.

  • While we aim to resolve urgent issues quickly, resolution timeframes cannot be guaranteed.


5. Billing & Invoices

  • All invoices must be paid within 7 days of the issue date unless otherwise stated.

  • Late payments may result in service suspension. After 14 days of non-payment, a 5% late fee of the invoice total will be applied.

  • Recurring invoices will be sent 7 days before the due date, and reminders will be automatically issued if payment is not received by or on the due date.

  • All prices are quoted in Sterling Pound (£) and are exclusive of VAT unless otherwise specified.

  • Hosting is billed separately and is not included in design or maintenance quotes.


6. Estimates & Proposals

  • All estimates and proposals are valid for 30 days from the issue date.

  • After this period, a new proposal will need to be generated based on current rates and scope.


7. Ownership & Intellectual Property

  • Upon full payment, you own the final website design, excluding any third-party licensed components (e.g., plugins, stock images, fonts).

  • We retain the right to showcase completed projects in our portfolio unless you specifically request otherwise in writing.


8. Termination

  • Either party may terminate the agreement with written notice.

  • Any completed work up to the termination date will be invoiced accordingly.

  • No refunds will be issued for services rendered or for prepaid subscription periods.


9. Limitation of Liability

  • We are not liable for any loss of revenue, business interruption, or data loss resulting from third-party services, software failure, or cyber-attacks.

  • Our total liability under these Terms will not exceed the amount paid by you for the affected service.


10. Amendments

  • We reserve the right to update or modify these Terms.

  • Clients will be notified of any material changes via email or through the Lucid Pulse Portal.
